This document, and any other documents we refer to within it, inform you of the terms and conditions under which we will supply any of our products, as catalogued on this website, to you. Please take care to read these terms and conditions carefully before ordering any of our products through our website. You should also read our Privacy Policy and our Terms of Use.
In purchasing products through this website, you should understand that you accept each of our terms and conditions (this document) our Privacy Policy and our Terms of Use. And that these terms and conditions as binding on your purchase.
It is advisable that you print a copy of these terms and conditions for your future reference.
Before placing an order with us you will be required to accept these terms and conditions. You can refuse to accept these terms and conditions, but please understand that if you refuse to accept these terms and conditions, or our Privacy Policy, you will not be able to order any Products from our site.

2. WHO YOU ARE
By placing an order through our site, you warrant that you are legally contractually able to enter into a binding agreement with us, e.g., if you are a person, you are over 18; if you are a Limited Liability Company, your Memorandum and Articles of Association authorise you to enter into this contract.
3. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US
If you decide to order some of our Products from this website, you can select the Products to be ordered, which will be included in your “basket”. At this point, this website will link with our stock database to confirm whether the selected Products are available in stock (any order is subject to availability). You will then be requested to submit your personal and credit card details to our payment provider, PayPalor Worlnet tps. After placing an order, you will receive an order confirmation from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product
Before placing an order a window will appear on the screen asking you to confirm the order and the information provided to us, so you can correct input errors before placing your order.
We will despatch all ordered products as soon as possible after receipt of your order (usually within 24 hours). In the event that there will be a known delay in such despatch, we will inform you by email that this is the case, and attempt to give you an accurate estimate of when your order will be despatched, and when you can expect delivery of your order.
4. LINKS TO THIRD PARTIES WEBSITES
We may also provide links on our site to the websites of other companies, whether affiliated with us or not. We cannot give any undertaking, that products you purchase from third party sellers through our site, or from companies to whose website we have provided a link on our site, will be of satisfactory quality, and any such warranties are DISCLAIMED by us absolutely. This DISCLAIMER does not affect your statutory rights against the third party seller.
5. CONSUMER RIGHTS
You may cancel a Contract at any time within thirty (30) days, beginning on the day after you received the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with our returns and refunds policy set out in Clause 9 below.
To cancel a Contract, you must inform us in writing using our returns form and return the Products to us immediately, in the same condition in which you received them, and at your own cost and risk as set out in Clause 9 below.
This provision does not affect your statutory rights.
6. AVAILABILITY AND DELIVERY
Subject to Products availability, Mrs. Harper's Boutique aims to deliver goods within, 1 working day of receipt of order for Irish Deliveries, 3 to 7 working days of receipt of order for deliveries outside of the Irish Republic but within the EU, and between 3 to 7 working days of receipt of order for Non EU and Rest of world Countries. Your order will be fulfilled by the delivery date set out in the Despatch Confirmation or, if no delivery date is specified, then within 28 days of the date of the Despatch Confirmation, unless there are exceptional circumstances out of our control, as specified in Clause 15. Worldnet tps or Paypal will charge your credit card for the amount of the transaction at the time you place your order.
Removal of footbeds and replacement with different soles or changing the heel will invalidate Mrs. Harper's Boutique’s guarantee of reasonable wear and tear. Mrs. Harper's Boutique boots and shoes are not designed to take any other soles or heels other than it's own. Please note that Mrs. Harper's Boutique footwear is not manufactured for use with orthotics which can result in abnormal wearing of soles, we therefore regret to inform you that the use of orthotics in our footwear negates guarantees to soles, zips and stitching.
We have tried our utmost to portray the detail, colours and leather texture of the footwear correctly. However, due to photographic variation and computer settings please allow for slight variation and no liability can be accepted for any slight variation arising as aforesaid.
7. RISK AND TITLE
The Products will be at your risk from the time of delivery.
Ownership of the Products will only pass to you on delivery to your designated address.
8. PRICE AND PAYMENT
The price of any Products will be as quoted on our site from time to time, except in cases of obvious error, but prices quoted on our website shall be deemed to be advertisements only and not offers.
These prices include VAT but exclude delivery costs, which will be added to the total amount due for each Product ordered as set out in our shipping price guide.
Prices on our website are liable to change at any time, but changes will not affect orders already placed and paid for.
Our site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on our site may be incorrectly priced. We will normally verify prices as part of our despatch procedures so that, where a Product's correct price is less than our stated price, we will charge the lower amount when despatching the Product to you. If a Product’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before despatching the Product, or reject your order and notify you of such rejection.
We are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you a Despatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.
Payment for all Products must be in Euro. We accept payment with PayPal.
We do not store any credit card details on our website or servers. This is taken care of by our payments provider PayPal.
9. OUR RETURNS AND REFUNDS POLICY
When you return a Product to us (for instance, because you have cancelled the Contract between us, or have notified us in accordance with Clause 19 that you do not agree to any change in these terms and conditions or in any of our policies, or because you claim that the Product is defective), we will examine the returned Product and will notify you of your refund or exchange via e-mail within a reasonable period of time. We try to process returns as soon as they arrive. However, during very busy periods, please allow 10 days for your refund or exchange to be processed. We will usually refund any money received from you using the same method originally used by you to pay for your purchase.
If you are not completely satisfied with your mail order purchase you can return your order to us at any time within ten (30) days of receipt, for a full refund on the cost of the Products or an exchange. Exchanges are subject to availability. Products must be returned unworn and undamaged in their original packaging with the original purchase receipt.
To return: Write on the back of Mrs. Harper's Boutique receipt indicating clearly whether you would like an exchange or a refund. Slide the returned product (in their box and with the tissue paper intact) along with the receipt into a mail bag or box and seal using parcel tape. Send to,
THE GLASS SLIPPER, PRESTON PLACE, TRIMGATE STREET, NAVAN, COUNTY MEATH, REPUBLIC OF IRELAND. Take your parcel to the nearest post office and post. We recommend that you send returns by special delivery so that they are insured for you and are traceable. The cost of returning Products to Mrs. Harper's Boutique is borne by you.
All Mrs. Harper's Boutique Products are checked for quality before they are sent to you. Customers can expect Mrs. Harper's Boutique boots and shoes to remain of satisfactory quality throughout their reasonable life expectancy, so long as they are maintained correctly and not misused. Footwear should only be fitted on carpet for protection. Returned goods found to be worn, damaged, marked, soiled or scratched will not be refunded or exchanged. Mrs. Harper's Boutique cannot guarantee against standard wear and tear and we reserve the right to seek a second opinion from an independent body when defect inspections are required. If the product is deemed to have a manufacturing defect or is not fit for purpose we will offer an exchange or refund. If we are unable to repair the product, we will exchange or refund, at our discretion. Mrs. Harper's Boutique will assess each repair claim independently. Your statutory rights are not affected.
Returned Products must be in their original packaging. We reserve the right to deduct the value of repackaging for any Products not returned in their original packaging. All returns should be accompanied by original documentation for credit purposes, and clearly state the reason for return. Refunds or exchanges will not usually be given for Products returned without a Mrs. Harper's Boutique reciept and full adherence to our terms and conditions. We advise that you to use a traceable and insured postal service to return your products to us, we cannot be held responsible for goods lost in transit. Postage charges for returned Products are the full responsibility of the purchaser, and are non refundable by Mrs. Harper's Boutique. In the case of an exchange, postage charges to deliver the new item to the purchaser are the full responsibility of the purchaser and are non refundable by Mrs. Harper's Boutique.
10. OUR LIABILITY
We warrant to you that any Product purchased from us through our site is of good quality and fit for purpose.
Our liability in connection with any Product purchased through our site is strictly limited to the purchase price of that Product.
We accept no liability for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time or for any indirect or consequential loss or damage of any kind however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
11. IMPORT DUTY
If you order Products from our website for delivery outside the Eu, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.
12. WRITTEN COMMUNICATIONS
Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
13. NOTICES
All notices given by you to us must be given to Mrs. Harper's Boutique at PHOENIX HOUSE CORBALLIS, KILBERRY NAVAN CO MEATH IRELAND. We may give notice to you at either the e-mail or postal address you provide us with when placing an order, or in any of the ways specified in Clause 12. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.
14. TRANSFER OF RIGHTS AND OBLIGATIONS
The contract between you and us is binding on you and us and on our respective successors and assigns.
You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.
We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.
15. EVENTS OUTSIDE OUR CONTROL
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event), including (without limitation) the following:
Strikes, lock-outs or other industrial action.
Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
Impossibility of the use of public or private telecommunications networks.
The acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event. In the event we are unable to do so then; on either you or us giving 21 days notice of a termination of the contract; this contract shall be at an end with you entitled to a full refund subject to the return of our product in the same condition as it had been sent to you.
16. WAIVER
If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
A waiver by us of any default shall not constitute a waiver of any subsequent default.
No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with Clause 13.
17. SEVERABILITY
If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
18. ENTIRE AGREEMENT
These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.
Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in these terms and conditions.
19. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
Mrs Harper’s Boutique have the right to revise and amend these terms and conditions from time to time. You will be subject to the policies and terms and conditions in force and posted onto our website at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Despatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).
20. LAW AND JURISDICTION
Contracts for the purchase of Products through our site will be governed by the Law of the Republic of Ireland. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of Ireland.
